Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the ImagineMyPet mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Age Requirement: You must be at least 13 years of age to use ImagineMyPet. The App is not intended for children under 13.

2. Description of Service

ImagineMyPet is a mobile application that uses artificial intelligence to generate custom images and videos of pets based on user-provided reference photos and text prompts. The App provides tools for AI-powered content creation, storage, and optional community sharing.

3. User Accounts & Authentication

• You must create an account using a valid email address to access full App features
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information during registration
• You must verify your email address to complete account setup
• You must notify us immediately of any unauthorized use of your account

4. Token System & Subscriptions

Tokens: The App operates on a token-based system. Each generation (image or video) consumes tokens based on complexity:

• Images: 25 tokens
• Videos without audio: 125 tokens
• Videos with audio: 125–185 tokens depending on model

Free Trial: New users receive 25 tokens upon account creation, subject to a global daily limit of 200 tokens across all new users.

Subscriptions: Premium subscriptions provide monthly token allocations:

• Monthly Pro: 1,200 tokens per month
• Yearly Pro: 1,200 tokens per month for 12 months (billed annually)

One-Time Purchases: Additional tokens may be purchased as one-time top-ups.

Token Policies:

• Tokens never expire
• Tokens are non-refundable once purchased (except as required by law or in cases of technical error)
• Subscriptions auto-renew unless cancelled via your app store account settings
• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused tokens or early cancellation

5. Content Ownership & License

Your Content: You retain full ownership of all photos, images, and videos you upload or generate using the App.

License to ImagineMyPet: By using the App, you grant ImagineMyPet a non-exclusive, royalty-free, worldwide license to:

• Process your uploaded photos to generate AI content
• Store your generated content on our servers
• Use your content to improve our AI models and services
• Provide technical support and troubleshooting

Community Content: By publishing content to the Explore/Community feed, you additionally grant ImagineMyPet a non-exclusive, royalty-free, worldwide license to:

• Display your content within the App's community features
• Share your content on ImagineMyPet's social media channels (Instagram, TikTok, Facebook, YouTube, etc.) for promotional purposes
• Credit will be provided when reasonably possible
• Once content is published to the community feed, it cannot be unpublished, as you have received token compensation in exchange for granting usage rights

Your Right to Delete: You may delete any uploaded photos or generated content at any time through the App interface. Deletion is permanent and cannot be undone.

6. Acceptable Use Policy

You agree NOT to use ImagineMyPet to:

• Generate illegal, abusive, harassing, or harmful content
• Create content that infringes on others' intellectual property rights
• Generate sexually explicit, violent, or hateful content
• Impersonate others or misrepresent your identity
• Attempt to reverse engineer, hack, or bypass the App's security measures
• Use the service for commercial purposes without proper licensing
• Abuse or exploit the referral or free trial systems
• Upload photos you do not own or have permission to use
• Violate any applicable laws or regulations

ImagineMyPet reserves the right to remove content and suspend or terminate accounts that violate this policy.

7. AI Service Limitations

"As Is" Service: AI-generated content is provided "as is" without guarantees of specific results.

Variability: Generation quality, processing time, and output may vary based on:

• Prompt complexity and clarity
• Reference photo quality
• System load and demand
• AI model limitations

No Guarantees: We do not guarantee that:

• Every generation will meet your expectations
• The AI will perfectly reproduce reference photos
• Processing will complete within a specific timeframe
• The service will be uninterrupted or error-free

Token Consumption: Tokens are consumed when generation begins, regardless of whether you are satisfied with the output. Tokens are NOT refunded for unsatisfactory results.

8. Third-Party Services

The App utilizes the following third-party services:

AI Generation:

• fal.ai (AI infrastructure provider)
• Google Veo (video generation model)
• OpenAI Sora (video generation model)
• nano-banana (image generation model)

Backend Services:

• Firebase (Google) – Authentication, database, storage, analytics
• RevenueCat – In-app purchase processing
• Expo – Push notifications

Each third-party service has its own terms of service and privacy policy. By using ImagineMyPet, you agree to comply with their terms as well.

9. Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

10. Intellectual Property

The ImagineMyPet App, including its design, functionality, branding, and underlying technology, is owned by ImagineMyPet and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

11. Warranty Disclaimer

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IMAGINEMYPET DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGINEMYPET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL IMAGINEMYPET'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO IMAGINEMYPET IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

13. Account Termination

By You: You may delete your account at any time through the App's Settings. Account deletion is permanent and will result in the loss of all tokens, content, and account data.

By Us: We reserve the right to suspend or terminate accounts that violate these Terms, without refund.

14. Changes to Terms

We may update these Terms from time to time. Significant changes will be announced in the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.
